Accordingly to the Internet Technology and Law Rules changes, L’Atelier Aquafitness reserves the right to make changes to the terms at any time without your consent. Although L’Atelier Aquafitness may attempt to notify you when major changes are made to these terms. We may, in our sole direction, change, modify, suspend, make improvements to or discontinue any aspect for the website, temporarily or permanently, at any time without notice to you, and we will not be liable for doing so.
PROHIBITED CONDUCT
In your use of the website, you may not: (i) infringe any patent, trademark, trade secret, copyright, right of publicity or other right of any party, or submit content that is obscene, threatening, defamatory, or otherwise inappropriate; (ii) disrupt or interfere with the security or use of the website or any websites linked to the website; (iii) interfere with or damage the Website, including without limitation, through the use of viruses, cancel bots, Trojan horses, harmful code, denial of service attacks, forged routing or electronic mail address information, or similar methods or technology; (iv) impersonate another person or entity, misrepresent your affiliation with a person or entity, including without limitation, us, or use a false identity; (v) attempt to obtain unauthorized access to the website; (vi) engage, directly or indirectly, in transmission of spam, chain letters, junk mail, or any other type of unsolicited solicitation; (vii) collect or use , for any purpose, information about other users of the website without their or our written consent; (viii) submit false or misleading information to us; (ix) violate any applicable law, rule or regulation; (x) engage in any activity that interferes with any third party’s ability to use or enjoy the website or assist to encourage any third party in engaging in any activity prohibited by the terms.
USER ACCOUNT AND PASSWORD SECURITY
You must create your own account on the website by completing the online registration form process on the website. By doing so, you must provide us with a complete registration information, and update it if this information changes. It is important to keep your e-mail address associated with your current account because although you may be able to log into your account. With this you authorize us to handle personal information in order to use it for the purposes consent by law and related to the service we offer. After registration, we will create an account for you and assign you, or allow you to select, a password. You must keep your password confidential. You will be responsible for all use of your password, including any use by any unauthorized party. For security purposes we recommend you to notify us immediately if you believe your password may be used by any unauthorized person or entity. Our employees will never ask you for your password. You must notify us immediately if you receive such a request. We reserve the right to suspend or terminate your use of the web site if we believe that your password is being used without permission in a manner that may disrupt the website. Also L’Atelier Aquafitness will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of L’Atelier or others due to such unauthorized use.
RESERVATIONS
In order to make a reservation, you must first own a discovery/single class or a series of classes (package of classes). To buy an individual class or a package of classes, you can sign up online on our website and visit our boutique for the payment procedure. We require payment first upon booking a class. Please be aware that classes and packages have their validity, and future prices are subject to change. We accept cash or credit cards. Payments may only be made at L’ATELIER Aquafitness Boutique.
L’ATELIER will not process any reservation not unless it is already paid.
CANCELLATION POLICY/CLASS CHARGES
In order to cancel a class, you must do it 24 hours before the start of the class otherwise your class will be charged to you. Please note that we don’t do any refund of classes. You can reschedule a class 2 times maximum.
You can cancel your reservation in the following ways:
- Sending us an email 24 hours in advance prior to your booking, informing that you wish to cancel your class.
- Calling us on our hotline 24 hours in advance prior to your booking, informing that you wish to cancel your class.
CLASS PACKAGES AND PROMOTIONS
All class packages and promotions pursued are personal and can be used only by the direct client. You cannot transfer to another customer you packages or classes pursued. Please read the following waiver and relese (11).
FEES
You acknowledge that L’Atelier charges fees for the services, and reserves the right to change its fees from time to time in its sole direction.
SECURITY
We employ measures designed to ensure the security of the website, but make no guarantees in this regard.
COMMENTS
All comments, feedback, ideas, and other submissions that you disclose, submit or offer to us in connection with your use of the website (COMMENTS) will become our exclusive property. Such disclosure, submission or offer of any Comments shall constitute an assignment to us of all worldwide right, title and interest in all patent, copyright, trademark and other intellectual property. You should not submit any Comments to us if you don’t wish to assign such right to us. You are and shall remain the solely responsible for the content of any Comments you make. We are and will be under no obligation: (i) to maintain any Comments in confidence; (ii) to pay to you or any third party any compensation for any Comments; (iii) to respond to any Comments.
WAIVER AND RELEASE
By signing up for and/or attending classes, events, activities, and other programs and using the premises, facilities and equipment individually and/or collectively, of L’Atelier Aquafitness,I, the undersigned, have read and understand the General Rules of L’atelier Aquabiking Boutique. I acknowledge a full understanding of the inherent dangers and risks associated with the use of this facility/wellness activity occurring therein. I acknowledge that participation in this facility is strictly voluntary. I acknowledge it is recommended that I seek approval from my physician before implementing an exercise regimen, as depending on my personal condition, there may be health risks associated with this type of workout. I also understand that it is my responsibility to secure a medical certificate in advance, if desired. I declare myself to be physically fit and suffering from no serious condition, impairment, disease, infirmity, other illness that would prevent my participation in L’Atelier Aquafitness activity. I acknowledge that I have either had a physical examination and have been given a physician’s permission to participate in these activities, or I have decided to participate in these activities without the approval of my physician. In consideration for being permitted to participate in this program, and because I assume all risks involved, I hereby agree that I am responsible for any resulting personal injury which may occur as a results of my participation or arising out of my participation in the Aquabiking boutique or any fitness/wellness activity occurring therein.
I ACKNOWLEDGE THAT I HAVE THOROUGHLY READ THIS CONSENT AND RELEASE AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. BY SIGNING THIS DOCUMENT, I AM WAIVING ANY RIGHT I OR MY SUCCESSORS MIGHT HAVE TO BRING
A LEGAL ACTION OR ASSERT A CLAIM AGAINST L’ATELIER AQUAFITNESS FOR ANY INJURY SUSTAINED.
HEALTH RELATED INFORMATION
L’Atelier provides information on the website for informational purposes only. It is not meant as a substitute for the advice of a doctor or other health care professional. You should not use the information available on our website for diagnosing or treating a medical condition.
LIMITATION OF LIABILITY
In no event will L’Atelier be liable to you for any direct, indirect, special or other consequential damages resulting from your use of the website, or any other hyper linked website, including without limitation, any lost profits, business interruption, loss of programs or other data on your information handling system or otherwise, including any claims waived by you claims previously in this agreement or other even if we are expressly advised of the possibility of such damages.
ONLINE PAYMENT POLICY
Visa and Master Card and in AED will be accepted for payment

o We will not trade with or provide any services to OFAC and sanctioned countries
o An email notification will be sent within 24 hours to the customer for confirmation of payment received

To the fullest extent permitted by law, L’Atelier, its managers, employees and agents disclaim all warranties, express or implied in connection with the website and your use thereof. L’Atelier makes no warranties or representations about the accuracy or completeness of the website’s content of any websites linked to the website and assumes no liability or responsibility for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any: (i) errors, mistakes, or inaccuracies of content,(ii) personal injury or death or property damage, of any nature whatsoever resulting from your access to and use of our website or from the conduct of any users of the service, whether online or offline, (iii) any unauthorized access to or use of our secure serves and/or any and all personal information, (iv) any bugs, viruses, Trojan horses, or the like which may be transmitted to or through our website by any third party. In any content or any loss or damage of any kind as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the website.

JURISDICTION AND LOCAL LAW
You agree that these terms shall be governed by the internal laws of the United Arab Emirates. You hereby irrevocably submit to the exclusive jurisdiction of any United Arab Emirates court sitting in Dubai.
